Where an arson offender suffers substantial psychiatric problems and the offending was directed only at the offender's own property with no prospect of gain, general deterrence may be wholly inapplicable and a non-custodial sentence may be appropriate. The principle of proportionality precludes imposing a community correction order merely for the purpose of protecting the community where the offender has already served sufficient time in custody.
