Where the sole ground of appeal is that a judgment was procured by fraud and the allegation is contested, the Court of Appeal will not itself determine the issue if it requires oral evidence and cross-examination. The appropriate course, following Noble v Owens, is to allow the appeal to the extent of referring the fraud issue to the trial court, and to otherwise dismiss the appeal without adjudication on the merits.
