Where a party alleges that a judgment was procured by fraud, an appellate court will only entertain the allegation as a ground of appeal where the fraud is admitted or the evidence is incontrovertible. Where there is likely to be factual dispute, the matter must be pursued in separate equity proceedings. Grounds of appeal that do not challenge findings of fact but challenge the legal characterisation of admitted or found facts are sufficiently specific under r 51.18(1)(e).
