An accused's co-operation with the Crown and facilitation of a trial through admissions may attract a sentencing discount for utilitarian benefit even where remorse is not demonstrated, but each case depends on its circumstances, and admissions made for strategic reasons in the face of overwhelming evidence may not warrant any discount. An accused who successfully objects to the Crown's use of a co-conspirator's out-of-court statement cannot then invoke the same statement as exculpatory evidence in his own case, as the proposed use remains hearsay.
