An intensive correction order cannot be made for a sentence that includes any full-time custody under s 29(1)(b) of the Crimes (Sentencing) Act 2005 (ACT), which appears to include sentences backdated for pre-sentence custody. Where an intensive correction order is considered more beneficial than credit for time served, the court may decline to backdate the sentence.
