Leave to appeal from an interlocutory decision refusing to set aside a notice to produce will not be granted where the applicant raises no issue of principle and cannot demonstrate significant injustice, even where the applicant contends the primary judge misapprehended the evidence. A notice to produce may seek documents going to credit and motivation of witnesses, not merely documents relating to matters in issue on the pleadings.
