A solicitor who forms the view that an appeal lacks prospects may be granted leave to withdraw, as it is inconsistent with the solicitor's paramount duty to the court to be required to continue prosecuting the application. However, the manner of withdrawal must be proper — filing a notice of ceasing to act without leave and deposing to privileged legal advice are unsatisfactory. An applicant who fails to comply with directions for filing appeal books and fails to appear will have leave refused where no reasonably arguable ground of appeal is demonstrated.
