The Court awarded pre-judgment interest under s 100 of the Civil Procedure Act from the date the debt fell due, rejecting the defendant's argument that a genuinely contested dispute and related Supreme Court set-off proceedings warranted withholding interest. Indemnity costs were ordered from the day after an unaccepted Calderbank-style offer under UCPR r 42.14, where the plaintiff's judgment was no less favourable than the offer. A gross sum costs order of $26,187.19 was made based on detailed solicitor evidence applying mid-point discounts (70% for ordinary costs, 85% for indemnity costs), the Court finding the material logical, fair and reasonable and rejecting the defendant's objections that the evidence was impressionistic or that further discounts were warranted.
