A 'proposal' under s 218E of the Local Government Act 1993 (NSW) is the proposal to amalgamate local government areas, not the contents of the proposal document. The statutory inquiry under s 263(2A) is a compulsory process in aid of the examination function, not the examination itself; the Delegate may conduct aspects of the examination outside the public inquiry. The Boundaries Commission's review and comment function under s 218F(6) does not require an independent evaluation of the proposal or public consultation. Misleading representations not contained in statutory notices or documents required by the Act cannot invalidate the amalgamation process.
