Under s 218F(6)(b) of the Local Government Act 1993 (NSW), the Boundaries Commission's function is confined to reviewing the Chief Executive's report and commenting on it; it is not required to independently re-examine the merits of the Minister's amalgamation proposal. The content of the Minister's procedural fairness obligation at the final stage of the amalgamation process is limited to allowing adequate opportunity to identify and correct factual errors and misconceptions, assessed by reference to the opportunities already afforded at earlier stages. A delegate examining an amalgamation proposal is not required to disclose proposed adverse findings on the weight to be given to a community poll before finalising the report.
