Claims for judicial review cannot be brought by notice of motion in existing proceedings but must be commenced by separate summons with the decision-maker joined as a defendant. Where a cancellation of registration takes immediate effect and the practitioner's name is removed from the register, there is no continuing order capable of being stayed. The Court of Appeal has no jurisdiction to grant judicial review of its own decisions. A Teoh-type protective order may be made where a litigant repeatedly files motions seeking substantive relief in proceedings that have been dismissed.
