A District Court Judge's failure to make an express finding on each element of an offence under s 125 of the Crimes Act 1900 (NSW) does not constitute jurisdictional error where the finding is necessarily implicit from the rejection of the only defence advanced. The reasonableness of a claimed belief in a claim of right goes to its plausibility but is not determinative of whether the belief was genuinely held.
