A District Court judge conducting an appeal by way of rehearing may adopt the findings and conclusions of the Local Court magistrate for the reasons given by the magistrate, and such adoption does not of itself constitute jurisdictional error or error of law. Imprecise observations about the object of the Crimes (Domestic and Personal Violence) Act 2007 (NSW) in ex tempore reasons will not constitute jurisdictional error where, properly construed, they are directed to the parties as background rather than reflecting a misapprehension of the statutory function being performed.
