A single punch of moderate force to the head of an elderly person, even in circumstances of animosity and heightened anger, does not support an inference of intent to inflict grievous bodily harm sufficient for murder. Where theft occurs after an assault that has incapacitated the victim, the theft may reasonably be characterised as an opportunistic afterthought, precluding constructive murder based on aggravated robbery with wounding. Where a jury convicts of murder on a constructive murder basis, a substituted verdict of manslaughter under s 7(2) is unavailable because the jury has not necessarily been satisfied of the elements of manslaughter.
