Failure to quantify the discount for assistance to authorities under s 23(4) of the Crimes (Sentencing Procedure) Act 1999 (NSW) constitutes appellable error requiring re-exercise of the sentencing discretion. Co-operation during a police interview and admissions made therein relate more to the discount for a plea of guilty than to 'assistance' under s 23. There remains an unresolved conflict in NSWCCA authority regarding the interrelation between ss 23(4), 23(6) and 101A.
