Emails and Facebook messages sent to third parties about a complainant can constitute acts of stalking under the Criminal Code (Qld) even where the complainant did not directly see them, provided there is evidence the complainant became aware of their contents. The absence of medical or expert evidence does not preclude a finding of detriment under s 359B(d)(ii). A ground of appeal abandoned before the District Court cannot be revived on a further appeal to the Court of Appeal.
