The Court of Appeal may set aside and vary its own orders under r 667(1) UCPR where the orders were made on the mistaken assumption that particular sums were agreed between the parties. The power under r 667(2)(e) permits setting aside at any time where the party with the benefit of the order consents, even if the order has been filed. An order filed contrary to the presiding judge's direction to registry staff may not have been properly filed.
