A director seeking to rely on the s 588H(2) defence to insolvent trading must adduce evidence identifying the specific nature, monetary value, commitment, terms and timing of any financial support relied upon to establish solvency — general assertions of access to assets or support from related entities are insufficient to resist summary judgment. Joint expert reports prepared under r 429B of the UCPR (Qld) are not required to comply with the individual expert report requirements of r 428.
