Current sentencing practices for dangerous driving causing death at or above mid-category seriousness are inadequate and must be uplifted. Courts have failed to give proper effect to the 2008 doubling of the maximum penalty from 5 to 10 years. The inappropriately narrow range of sentences imposed to date should no longer fetter sentencing judges. Moral culpability is to be assessed by reference to all conduct and circumstances, not by a checklist approach identifying the absence of particular aggravating factors.
