A combined sentence of imprisonment and CCO for dangerous driving causing death may be within range even for serious offending where powerful mitigatory factors of youth and good character exist. A prosecution concession at first instance that a particular sentencing disposition is within range poses an additional impediment to a subsequent DPP appeal against that disposition. The Court signalled that current sentencing practices for dangerous driving offences may require future examination given the apparent modest increase in median sentences despite doubled maximum penalties.
