An offender's failure to provide any explanation for serious offending is a matter of significant concern that a sentencing judge may properly emphasise repeatedly, as it makes it difficult to reach any firm conclusion about prospects of reoffending. An error in the sentence on one charge does not necessarily reopen the sentencing discretion in respect of other charges where the error is confined to that charge.
