The definition of 'no current work capacity' in s 5 of the Accident Compensation Act 1985 (Vic) requires consideration of the worker's holistic ability to return to work in employment — not merely physical capacity to perform tasks. A Medical Panel must consider the entirety of the worker's personal circumstances, including age, education, skills, work experience, and the effects of prolonged injury-caused absence from the workforce, and whether those circumstances in combination render the worker's labour unmarketable. A Panel's reasons must disclose its actual path of reasoning in sufficient detail to enable review, and a generic statement that duties 'would be able to be undertaken' without reconciling the worker's limitations with the specific physical demands of the identified employment is inadequate.
