A trial judge exercising discretion to refuse to vacate a trial date is entitled to treat delay and the waste of scarce judicial resources as decisive factors, particularly where multiple previous trial dates have been vacated and the applicant has had ample time to seek the orders now sought. The Proceeds of Crime Act 2002 (Cth) has extraterritorial operation such that examination orders may be made in respect of persons resident overseas.
