A sentencing judge's finding as to an offender's motivation must be supported by evidence to the requisite standard. However, where the overall sentence is very moderate in the circumstances and the finding was not clearly material to the sentence imposed, an arguable error as to motivation will not warrant leave to appeal where there is no reasonable prospect of a less severe sentence. The application of Verdins principles in a manner reflecting the submissions made on the plea will not constitute specific error.
