A non-custodial sentence for aggravated burglary involving a planned home invasion with a firearm against a mother and young children is outside the range of sentences reasonably open, notwithstanding delay of approximately six years between offending and sentence and evidence of rehabilitation in the final months before sentencing. The significance of delay as a mitigating factor is diminished where there is no evidence of rehabilitation for most of the delay period and the offender had no recollection of the offending.
