Section 134AB(34) of the Accident Compensation Act 1985 (Vic) precludes the award of damages in the nature of interest on pain and suffering damages. This construction, established in Eccles v Taylor in respect of the relevantly identical s 93(15) of the Transport Accident Act 1986 (Vic), has been affirmed and is now entrenched by repeated parliamentary re-enactment of the same language.
