When sentencing an offender of advanced age, consideration of whether the sentence would be 'crushing' (destroying any reasonable expectation of useful life after release) inherently encompasses consideration of the proportion of remaining life to be spent in custody. These are not separate sentencing considerations requiring separate treatment. The 'firming up' principle for anomalously low maximum penalties may not extend to historical sexual offences where the maximum penalty was subsequently increased by legislative change.
