Pregnancy discovered but not disclosed at the time of sentencing, followed by birth and care of a child in custody, can constitute new evidence demonstrating the true significance of pre-existing facts (isolation from family, anxiety about deportation) sufficient to reopen the sentencing discretion on appeal under the R v Nguyen principles. The fact that the applicant did not inform her legal advisors of the pregnancy does not preclude admission of the new evidence.
