An allegation that a sentencing judge failed to give adequate weight to matters in mitigation is not, of itself, an independent ground of appeal. The loss of a career opportunity (here, AFL football) resulting from imprisonment does not render a sentence 'crushing' within the second limb of the totality principle where the offender retains the prospect of a useful life after release.
