An arrest under s 56A of the Bail Act 1992 (ACT) does not automatically revoke a pre-existing grant of bail. A person arrested under s 56A and brought before a court retains their existing bail, and the court's task is to determine whether bail conditions have been breached and whether to revoke, vary or continue bail — not to require a fresh bail application. This means the more onerous bail provisions (such as s 9D) do not automatically apply merely because of a s 56A arrest.
