An award of $150,000 for general damages was excessive for a 63-year-old plaintiff with a long history of pre-existing medical complaints significantly affecting quality of life and serious non-accident related conditions diagnosed post-accident, where the principal injury was a left knee injury requiring future knee replacement; $100,000 was substituted. Pleadings from other proceedings are excluded from the business records exception under s 69(3) of the Evidence Act 2011 (ACT) as documents prepared for the purpose of conducting proceedings, and judgments/orders from other proceedings are inadmissible under s 91 to prove facts in issue. Documents used in cross-examination to challenge credibility do not become independently admissible merely because they were shown to the witness; their evidentiary value lies in the answers given by the witness, not in the documents themselves.
