A discretionary costs order made payable forthwith with a stay of proceedings pending payment may miscarry where the party ordered to pay costs was not at fault in the circumstances giving rise to the costs, is impecunious, and the orders would stultify the proceedings. The duty of candour applicable to ex parte applications does not extend to contested interlocutory applications where both parties are represented.
