The R v Henry guideline for armed robbery applies with appropriate modifications to robbery in company under s 97(1) Crimes Act 1900. A sentencing judge's reference to the 'in company' element when assessing the R v Henry guideline factors does not constitute impermissible double counting where the reference is to a matter additional to the guideline factors. A failure to expressly refer to s 5 Crimes (Sentencing Procedure) Act 1999 does not of itself give rise to sentencing error.
