When a sentencing judge accumulates a sentence upon a pre-existing sentence and the combined non-parole period exceeds 75% of the total combined sentence, the record of proceedings must support an inference that the judge adverted to the impact of the accumulation on the non-parole period ratio; otherwise the deviation will be treated as inadvertent error warranting appellate intervention. It is preferable that sentencing judges make express comment in their remarks on sentence about the impact of accumulation on the statutory ratio.
