The ratio of non-parole period to head sentence in Commonwealth sentencing cannot be assessed mechanistically when multiple partly cumulative sentences are involved; the individual sentence imposed for the offence under consideration must be examined separately. Where error in the non-parole period is alleged, resentencing requires full re-exercise of the sentencing discretion (both head sentence and non-parole period), and the court will not intervene if resentencing would produce a longer sentence.
