In the ACT, guilty pleas entered at or after a Criminal Case Conference should attract a discount of at least 15%, and almost always within the range of 15-20%. A nonparole period will almost always fall within 50-70% of the head sentence where the head sentence is appropriate; a nonparole period exceeding 70% is unusual and requires clear explanation, generally with reference to remote prospects of rehabilitation. Where the Crown abandons charges as part of plea negotiations, the offender's discount should not be reduced on account of the withdrawn charges, as it must be assumed the offender was not guilty of those charges.
