Where the main proceedings have been resolved by settlement agreement, the Court will exercise its discretion to make a gross sum costs order to achieve finality and avoid further litigation over costs. A court may decline to order costs forthwith against a party who has an ongoing claim in the proceedings where there is a real risk of stultification of that claim, even where the costs relate to a discrete and concluded interlocutory matter.
