An acquittal on one count and a hung jury on another do not necessarily render guilty verdicts on remaining counts unreasonable where the acquitted/hung counts involved conduct of a different type or lesser seriousness. Alibi evidence directed only at the particularised date of an offence (rather than the substance of the complainant's account of the circumstances) will not meet the threshold for admission as fresh evidence on appeal where the date was not challenged at trial and was not a material element of the offence.
