A respondent's undertaking to hold monies recovered pursuant to a judgment in an Australian bank account pending appeal can obviate the risk that orders on a successful appeal might be ineffective, thereby defeating an application for a stay of execution. An offer of security by way of registered first mortgages over real property is not a sufficient alternative where the respondent would bear risks of delay and inadequate realisation on forced sale. The prospect of winding up for non-payment of a judgment debt is not a sufficient ground for a stay where there is no evidence of inability to pay.
