Payment of a judgment sum to a respondent's solicitors on the basis that it will be held on trust pending appeal does not satisfy the court's money order and does not stop post-judgment interest from accruing under s 59(2) of the Civil Proceedings Act 2011 (Qld). A money order requires unconditional payment such that the payee is entitled to possess and use the money as its own. Parties seeking to protect funds pending appeal while stopping interest should consider alternative arrangements.
