A contention that insufficient weight was given to a sentencing factor does not, of itself, articulate an error of the kind described in House v The King that vitiates the sentencing discretion, though it may be relied upon as contributing to manifest excessiveness. Drug addiction does not mitigate the sentence for commercial-scale trafficking where the scale of offending exceeds what is necessary to support the addiction. R v Leith does not establish that a sentence which may result in an offender dying in custody constitutes a miscarriage of justice.
