A guilty plea will not be set aside merely because the defendant claims to have been told by counsel that a non-custodial outcome was guaranteed, where the court finds the claim not credible and the defendant was aware of the nature of the allegations. Accurate advice that a defendant must either plead guilty or face the cost of trial does not render a subsequent guilty plea involuntary. For sentencing on maintaining an unlawful sexual relationship charges, the absence of force, violence, breach of trust, power imbalance, or manipulation, combined with mutual affection and the offender's youth, significantly reduces the appropriate sentence. Unsubstantiated self-diagnoses in victim impact statements should be treated with great caution.
