The totality principle, as applied to cross-border offending, requires moderation of the head sentence (not merely the custodial component) to reflect prior sentences in other jurisdictions. A suspended sentence of imprisonment must be given proper weight in totality considerations and should not be treated as equivalent to no punishment. The proper approach is to ask what would have been the effective head sentence had all offences been dealt with together in one jurisdiction.
