Fresh evidence of a Borderline Personality Disorder diagnosis obtained after sentencing, where the only mental health material before the sentencing judge was a psychologist's letter that made no findings or opinions, may demonstrate the true significance of facts in existence at the time of sentence and warrant leave to appeal. The Verdins principles do not extend to personality disorders such as BPD, but a BPD diagnosis may nonetheless be relevant to moral culpability and sentencing.
