In a circumstantial case, an alternative inference that the accused committed the offence charged but in a different manner from that alleged by the prosecution is not an inference consistent with innocence. Where the alternative hypothesis still establishes guilt through a different legal pathway (e.g., ss 7(c) or 8 of the Criminal Code), it cannot ground an unreasonable verdict appeal.
