The constitutional argument that Western Australian courts lack jurisdiction because of the removal of the Queen as head of the courts in 2004 continues to be rejected as entirely without merit. A vexatious proceedings order may be made against a person who has not personally commenced proceedings where they have shown a willingness to participate in claims that have no reasonable prospect of success or are an abuse of process.
