A licence disqualification order is not a 'sentence or penalty' under s 208(1)(d) of the Magistrates Court Act 1930 (ACT), and no appeal lies under that provision from a disqualification period equal to the automatic statutory minimum. Section 64 of the Road Transport (General) Act 1999 (ACT) does not provide power to impose a disqualification period equal to the automatic period; it only permits imposition of a longer period. An appeal under s 208(1)(d) does not lie from an order made beyond the jurisdiction of the Magistrates Court; the remedy is judicial review.
