Unlawful confinement offences in the ACT involving vigilante justice, prolonged detention, repeated violence, use of weapons, and the offender acting as instigator attract a starting point of approximately four years imprisonment. General deterrence is always a prominent sentencing purpose for vigilante-style offences. Where an offender has completed a manifestly inadequate sentence, the Court may still intervene on a Crown appeal but may suspend the balance of the increased sentence, particularly where co-offenders received lenient sentences that were not appealed.
