A party asserting confidentiality over client information who tenders that information in open court without seeking a confidentiality order will be taken to have caused the information to enter the public domain, defeating both equitable and contractual claims to restrain its use or disclosure. Non-interference covenants are directed to existing relationships and are not breached by originating new finance for persons who previously engaged the covenantee.
