Where the s 23(3) proportionality constraint prevents further discount on one offence, the court has discretion to apply the discount for assistance to a different offence. The absence of connection between the assistance and the offence being sentenced is a relevant consideration under s 23(2)(i) that may warrant a smaller reduction or no reduction at all. A combined discount for guilty plea and assistance exceeding 40 per cent on a mid-range drug supply offence may be unreasonably disproportionate.
